CONSUMER RIGHTS

GENERAL

1. By placing an order on this website, you acknowledge and accept the preliminary information form and the distant sales contract provided.

2. Buyers are subject to the German Civil Code (BGB) and the Consumer Rights Directive (Directive 2011/83/EU), along with other applicable laws and regulations governing the sale, delivery, and protection of consumer rights within the European Union.

3. Shipping fees related to product delivery are the responsibility of the buyer unless otherwise stated.

4. Each purchased product will be delivered to the person or institution designated by the buyer, within the legal limit of 30 days. If delivery is not completed within this period, the buyer may cancel the contract.

5. Products will be delivered fully and in compliance with the specifications outlined in the order, including any accompanying documents (e.g., warranty cards, user manuals, etc.).

6. If the delivery of the purchased product becomes impossible, the seller is obligated to inform the buyer within 3 days of becoming aware of the situation. Any payments made will be refunded within 14 days.

NON-PAYMENT OF PRODUCT VALUE

7. If the buyer fails to pay the product price or if the payment is canceled by the financial institution, the seller is not obliged to deliver the product.

UNAUTHORIZED CREDIT CARD USE

8. If the buyer’s payment is made using a stolen or unauthorized credit card and the relevant financial institution does not transfer the payment to the seller, the buyer must return the product to the seller within 3 days, with the shipping cost covered by the seller.

FORCE MAJEURE AND DELIVERY DELAYS

9. In case of unforeseen events (force majeure) preventing delivery, the seller will notify the buyer. The buyer may choose to:

  • Cancel the order,
  • Replace it with a similar product, or
  • Postpone delivery until the issue is resolved.

If the buyer cancels the order:

  • Payments made via credit card will be refunded to the issuing bank within 14 days.
  • The time required for the bank to transfer the amount to the buyer’s account may vary (typically 2-3 weeks).

PRODUCT INSPECTION OBLIGATION OF THE BUYER

10. Buyers must inspect the product upon delivery. Products with visible defects (e.g., damaged packaging, broken items) should not be accepted from the shipping company.

Accepted products are deemed to be in good condition.

If the right of withdrawal is to be exercised, the product must not be used, and all relevant documents (including the invoice) must be returned with it.

RIGHT OF WITHDRAWAL

11. Buyers have the right to withdraw from the contract without providing any reason or incurring penalties, provided they notify the seller within 14 days from the product’s delivery.

WITHDRAWAL PERIOD AND CONDITIONS

13. For service-based purchases, the 14-day withdrawal period starts from the date of contract signing. If service delivery begins with the consumer’s consent, the right of withdrawal cannot be exercised.

14. Any costs incurred due to the exercise of the right of withdrawal are borne by the seller.

15. Withdrawal requests must be submitted in writing via certified mail, fax, or email within the 14-day period. The product must remain unused, and the provisions outlined under “Products Exempt from the Right of Withdrawal” must be respected.

RETURN PROCESS AND CONDITIONS

16. If the invoice is issued to an institution, a return invoice must be provided along with the returned product. Orders with missing return invoices will not be processed.

17. All items must be returned in their original packaging, along with accessories (if applicable) and the return slip, without damage or use.

REFUNDS AND COMPENSATION

18. The seller will issue refunds and return all binding documents to the buyer within 10 days of receiving the withdrawal notice. The returned product must be accepted within 20 days.

19. If the product’s value decreases due to the buyer’s fault, the buyer is responsible for compensating the seller’s loss. However, normal wear from proper use during the withdrawal period will not incur liability.

20. If the order's total value falls below a promotional threshold due to withdrawal, the discount provided under that promotion will be canceled.

PRODUCTS EXEMPT FROM THE RIGHT OF WITHDRAWAL

21. The following products cannot be returned once their packaging is opened, per the relevant regulation:

  • Custom-made products or items tailored to personal needs,
  • Underwear, swimwear (including bikini bottoms), and cosmetics,
  • Disposable items and perishables,
  • Products that could become unsanitary if opened (e.g., food, personal care items),
  • Digital content, audio/video recordings, and software (if unsealed),
  • Newspapers, magazines (except under subscription agreements),
  • Services initiated with the buyer’s consent before the withdrawal period expires.

22. Stationery products (e.g., toner, cartridges) and media products (DVDs, CDs, cassettes) must be unopened, unused, and undamaged to qualify for return.

DEFAULT AND LEGAL CONSEQUENCES

23. In case of default on payments, buyers agree to pay interest and bear any legal fees under their credit card agreement.

If default occurs, the relevant bank may pursue legal action, and buyers will be liable for any costs or damages incurred by the seller due to the delayed payment.

PAYMENT AND DELIVERY

24. Payments can be made online via credit card or PayPal. Transactions will be processed at the time of order confirmation.

25. Once payment is completed, the order will be prepared and shipped through the chosen delivery method.
